AGB

1. Our offers are subject to change without notice regarding price, quantity, delivery time and availability.

2. Prices are in EURO; all prices are subject to statutory VAT.

3. Deliveries are made by UPS or postal service freight collect at the recipient's risk. Goods sent on approval or consignment travel and are stored at the recipient's expense and risk and must be insured against all risks. Transport damage must be reported immediately by the customer to the responsible transport company upon receipt of the goods, and claims for compensation must be made directly to the transport company.

4. Any defects in quality or quantity must be reported to us immediately upon receipt of the goods, but no later than 3 days thereafter. The buyer's claims for defects expire one year after delivery of the goods.

5. Invoices are due according to the agreed terms. If the payment deadline is exceeded, standard commercial default interest will be charged, payable immediately upon initiation.

6. The invoice amounts are payable from the invoice date within [timeframe].

• 10 days with a 3% discount via direct debit

• Payment within 14 days with a 2% discount via bank transfer
  
• 30 days without deduction via bank transfer
  

7. Verbal agreements require written confirmation to be valid. The burden of proof for special agreements rests solely with the party in question.

8. All goods deliveries are subject to retention of title until full payment has been received.

9. The purchaser is only authorized to resell the goods to end consumers. Resale to other retailers is prohibited.
In the event of any violation, a contractual penalty of €5,000 is payable.

10. This agreement and all terms and conditions between the parties are governed exclusively by German law.

11. The place of performance is Bayreuth. The place of jurisdiction for all disputes, including actions on bills of exchange or checks, arising from this contractual relationship is Bayreuth. By accepting the price list and placing an order, the above conditions are expressly and bindingly acknowledged. Previous offers and price lists are no longer valid.
